1. OUR TERMS
1.1 By registering with the website you agree to be bound by these terms and conditions.
1.2 We reserve the right at any time and from time to time in our sole discretion and with or without notice to modify or discontinue, temporarily or permanently, the website (or any part thereof) or your individual use of the website. You agree that we shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the website.
2. ACCESS
2.1 You agree to use the website only for lawful purposes, for personal and non-commercial use only and you agree not to copy or distribute any part of the website without VisitScotland's prior written permission.
2.2 You agree that your use of the website shall be at your sole risk. VisitScotland and its employees make no representations or warranties as to the accuracy or completeness of the website's content and VisitScotland shall not be liable to you in any way for any loss incurred by you arising out of your use of the website, save for death or personal injury.
2.3 You agree not to use any automated system that accesses the website in a manner that creates more requests for information or uploaded information that can be reasonably produced via a conventional web browser.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 We own all copyright in all features of the website (including, without limitation, the design of the web site, all logos, text and graphics on the website), except such user generated content as outlined below.
3.2 When you upload/post/publish content to the website, you grant VisitScotland a perpetual and irrevocable licence to use the videos, pictures and descriptive text on the visitscotland.com website and associated VisitScotland niche websites and in any other communications but only in connection with or when referring to the VisitScotland photo competition. Where possible you will be given appropriate accreditation. However you agree that VisitScotland can modify such images or information and make editorial revisions. Should VisitScotland wish to use any of the images uploaded for any other purpose, we will gain advance permission and agree compensation, if necessary, for usage.
4. USER GENERATED CONTENT
4.1 The content (images, descriptions and/or comments) uploaded/posted/published by you on the website may be audited at VisitScotland's discretion for compliance with these terms and conditions. VisitScotland has the right to remove any uploaded/posted/published content from the website for any reason. The uploading/posting/publishing of user generated content is subject to the terms of use outlined here and further guidance for the user is available on the website.
4.2 The user shall be solely responsible for uploaded/posted/published content on the website. Under no circumstances will VisitScotland be responsible for any loss or damage resulting from the uploading/posting/publishing of user generated content on the website.
4.3 You agree that you will not 1) upload/post/publish any material on the website which (i) is not your own and/or you do not own the copyright for (ii) you have not got permission from the originator for (iii) you have not got the permission of those person(s) who are subjects of the picture(s)/video(s)/comments to use, 2) upload/post/publish falsehoods or misrepresentations that could damage VisitScotland or any third party 3) upload/post/publish any content that is unlawful, obscene, pornographic, offensive or otherwise inappropriate 4) use the website to solicit for business 5) impersonate another person.
4.4 Content may be digitally enhanced to remove spots or scratches, but not manipulated. Entrants can enhance the picture to make it brighter, clearer, etc but not manipulate the content. VisitScotland reserves the right to exclude any image they believe may have been excessively treated so as to alter its authenticity.
4.5 If you are a copyright owner and you believe any user generated content on the site infringes upon your copyright or you believe that any user generated content is inappropriate for any reason you can notify VisitScotland - contact details below.
4.6 You agree not to include the name of any specific businesses within the text based content uploaded/posted/published on the site.
4.7 These terms and conditions shall be governed by and construed in accordance with the law of Scotland, and the parties submit to the non-exclusive jurisdiction at the Scottish courts. Contact details: VisitScotland CityBreaks team - 0131 472 2222
5 COMPETITION TERMS & CONDITIONS
5.1 This promotion is open to anyone over 18 resident in the UK or Republic of Ireland. Employees and their immediate families of VisitScotland/visitscotland.com, their agencies and anyone professionally connected with the Competition are not eligible to enter.
5.2 Closing date for the receipt of entries for the Competition is 29 February 2008.
5.3 The winner will be notified by email within three weeks of the closing date of the Competition.
5.4 VisitScotland shall select the prize-winner by third party adjudication to be performed by VisitScotland's agency or by a professional photographer.
5.5 VisitScotland's decision is final and no dispute will be entered into.
5.6 The prize is a £50 voucher for Klick Photopoint.
5.7 All elements of the prize are subject to availability.
5.8 No cash alternative or other prize is available.
5.9 No purchase is necessary to enter the Competition.
5.10 Entry into the Competition requires the consumer to provide their name and email address.
5.11 The winner's name and county will be made available by sending an SAE to 'VisitScotland CityBreaks Winter Photography Competition', c/o bd-ntwk, 29 Cochrane Street, Glasgow, G1 1HL.
5.12 By entering into the Competition, all participants will be deemed to have accepted, and be bound by, these terms and conditions.
